Booking Terms and Conditions

The Guild of Florida Owners LLC, who are the leading independent inspectors and accreditors of vacation accommodation in Florida.
1. The booking terms and conditions form the sole contract between Florida Property sales and rentals (Referred to as We) and the person signing the Booking Form, who must be over 18 years of age and who shall be deemed to sign this form on behalf of all the persons herein. No contract shall exist until we have received a confirmation form together with the correct “security/booking deposit” and/or ”full payment”. Your booking can be held provisionally, if required, and held for a maximum of 7 days to allow time for your completed booking form and “security/booking deposit” and /or “full payment” to be received.

2. The balance should be paid not later than 10 weeks before departure. If a booking is made within the 10-week period, “full payment” plus “security/booking deposit” must be received before the booking can be confirmed.

3. A “booking deposit” of £300 for Manatees villas must be provided at the time of booking to secure the villa in your name. This is used to secure/book the villa in your name at the time of booking and once you step over the threshold of your home becomes a "Security Deposit". Please note that normal wear and tear will not be deducted from the security deposit. We need to know if you break a cup for example, do not try to make repairs yourself as this could compromise the next guests' safety. Please report all damage/accidents to us.

4. The “security deposit” (less any applicable charges) will be refunded, by check. The Management Company must first complete its inventory and occupancy report and then await the receipt of the monthly utility bills and/or confirmation from the OWNER that we can return the deposit.
THEREFORE THE SECURITY DEPOSIT IS NORMALLY REFUNDED ON THE 18TH DAY OF THE FOLLOWING MONTH AFTER YOUR DEPARTURE.
Renters are liable for all damage and loss to the villa during their stay. We and our agents reserve the right of entry at any time.
PLEASE NOTE THAT THE SECURITY/BOOKING DEPOSIT WILL BE FORFEITED IF YOU DO NOT PAY THE FINAL BALANCE DUE.

5. The accommodation rates quoted are PER WEEK (not per person), and include electricity, air conditioning, heating (when applicable), local telephone calls, cable TV, bed linen, towels, the use of all the amenities and facilities.
FLORIDA SALES AND TOURIST TAX MUST ALSO BE PAID IN ADDITION TO THE RATES QUOTED.

6. We reserve the right to move you to an equal or better home in the unlikely event of damage, flood or other event out of our control rendering the home you booked unavailable.

7. Please note that SMOKING IS NOT PERMITTED INSIDE ANY OF THE VILLAS, though it is permitted on the patio area by the pool. This keeps the villa odour free and also avoids the trouble of the sophisticated smoke detectors being triggered by the cigarette smoke. If the Management Company discover evidence of smoking in the villa, this will be taken into account when assessing your “security deposit” refund, and your co-operation is therefore requested and appreciated.

8. The accommodation may only be sub-let, shared or assigned by you with our express written agreement, otherwise only by persons detailed on the booking form are permitted to stay in the villa. The maximum occupancy is quoted for each villa and is determined by the authorities within strict guidelines for fire safety. Please note that contravention of the above will render your booking void and all moneys will be forfeited.
NO PETS ARE ALLOWED IN THE VILLAS.

9. The rental period begins at 16.30 hours on the day of arrival and terminates at 10.00 hours on the day of departure. The villa is professionally cleaned and inspected before and after each rental to ensure that all guests have a comfortable stay. Lawn and Pool care are provided on a weekly basis. Please note that each self-catering villa has only an initial supply of consumables (bin bags/toilet rolls/washing powder etc.) Once these have been used it is NOT the responsibility of the management company to replenish these items during your stay. The consumables supplied vary from villa to villa and should be adequate for the first few days of your stay.

10. Cancellations must be confirmed to us in writing. In the event that you cancel your reservation, or we have to cancel the arrangements due to non payment of the balance due within the time allowed before departure, cancellation charges will be made as follows;
• Date of booking - 10 weeks before vacation: CHARGE- LOSS OF SECURITY/BOOKING DEPOSIT
• After final balance is received (10 weeks before vacation): CHARGE- 100% Deducted


11. You are strongly recommended to take out adequate holiday/vacation insurance to cover possible cancellation as soon as your reservation is definite.

12. We cannot accept liability for death, personal injury, sickness, accident, delay or loss of luggage or personal effects or any other loss or misadventure which may occur whilst renting one of our villas. Use of the pool, any community pool, aqua area, tennis court & recreation areas is entirely at your own risk. It is particularly important that children are supervised at all times in and around the pool areas, the pools are between the depth of 3 to 6 feet. All homes will be fitted with door alarms on the doors leading into the pool area or pool fence.
DO NOT TAMPER WITH THESE LIFE SAVING DEVICES. ACCORDING TO CHAPTER 515.33 RESIDENTIAL SWIMMING POOL SAFETY ACT ANYONE TAMPERING OR DISCONNECTING POOL ALARMS COMMITS A MISDEMEANOR OF THE SECOND DEGREE, PUNISHABLE BY A $5000 FINE OR 1 YEAR IN JAIL.

13. Force Majeure. We accept no responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond our control, including, but not restricted to, war, terrorist activity, civil commotion, flight delays or cancellations, airport closures, adverse weather conditions, fire, flood, or industrial dispute.

14. We cannot accept any liability for failure of public supplies such as water, electricity, gas supplies. Nor for the consequences of the actions or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control. We cannot accept any liability for air conditioning systems, or of pool heaters or any household appliances breaking down. All reasonable steps will be taken , however to get the engineer out as soon as possible to rectify any problem. This does not affect your statutory rights as a consumer.

15. We cannot accept any liability for your personal safety during your holiday vacation. You are reminded to exercise care as to your personal safety, and the safety of your companions. Whenever possible, valuables should be left in a secure place and out of sight.

16. ALL CLIENTS SHOULD POSSESS VALID PASSPORTS AND ANY VISA REQUIRED.
All British citizens require a full 10-year passport valid for a period of at least six months beyond the holiday/vacation return date. The majority of visitors to the USA from Britain no longer require a visa as a result of the Visa Waiver Programme. It is, however, the holidaymaker’s responsibility to make sure that they have all the correct travel documents. If you have any queries you are advised to contact the US Embassy for details. We cannot accept liability for any aforementioned conditions not being met or any refusal of passage.

17. We reserve the right to decline or retain any person as a client whose conduct is “deemed to be disruptive” and affects the enjoyment of other holidaymakers/residents. We shall be under no liability to accept any costs incurred, or responsibility for, any such person. Some of the neighbourhoods have full time residents, so please respect their privacy and try to keep noise to a minimum after 10.30 pm.

18. Gas grilles, BBQs are not allowed on the pool deck or within the screened area. Extreme care should be taken if a gas grill or BBQ is used outside the screens as the risk of fire is great.

19. All descriptions given on the web site are made in good faith, but no liability can be accepted for error or omission and are subject to change as and when required.

20. Should you experience any problems whatsoever with the villa during your stay, please contact the Local Management Company immediately, who will do their best to assist and rectify the matter as soon as it is practically possible. We cannot resolve a problem for you unless we/one of our agents are notified of it at the time. Please give us the "opportunity" to correct matters. Should a problem remain unresolved, you are asked to notify us in writing within 7 days of your return. No action can be taken or liability accepted for any complaints received after this period. We aim to resolve complaints within a 2-month period from receipt, the details of which will be kept confidential to only the parties involved.

21. Please note that, as Florida is a tropical State, insects such as ants and the like are occasionally inevitable, and are not cause for complaint. The villas are treated periodically as part of a pest and termite control programme, and are professionally cleaned after each rental.
